A Revocable Living Trust, also called a Family Trust, is a document that allows you to establish a separate entity (the Trust) to "hold" legal title to your assets. Typically while you are alive you will serve as the Trustee and retain complete control over your assets. Upon your disability or death, the successor you appointed within the Trust will take over to manage and distribute the assets.
A properly drafted Trust can accomplish many goals, including guardianship, and probate avoidance for your estate, as well as protection for beneficiaries with special needs.
After your Trust is created, there is "homework". This consists of transferring title of your assets to the Trust, or changing the beneficiaries designated on certain assets. This will be discussed in depth during your consultation.
If you have a blended family, i.e. children from a previous relationship, a Trust can outline how your assets will be divided between your current spouse and your children, so nobody becomes a victim of the Arizona intestacy laws.
